In a Nutshell
By decision of 26 April 2023, the Swiss Federal Tribunal (SFT) dismissed an appeal lodged by a football club (Appellant or Club) against a CAS Court Office letter dated 21 November 2022, by means of which the Court of Arbitration for Sport (CAS) refused to proceed on the grounds that the Appellant had failed to comply with the formal requirements set out in Article R.31.3 of the CAS Code.
The Club alleged that the CAS had formally denied justice and that the composition of the Arbitral Tribunal was irregular.
Both arguments were rejected by the SFT.
