Detailed Analysis of the Diarra Ruling: Towards a Revolution of the Transfer System?

On 4 October 42024, the Court of Justice of the European Union (CJEU) gave its ruling in case C-650/22, known as Diarra. This decision could significantly overhaul FIFA's transfer system in Europe and, consequently, worldwide. In a nutshell, the CJEU stated that FIFA rules hinder the free movement of players and restrict competition between clubs. The consequences of such a ruling are yet to be seen.

Facts and Procedure

 

This case, of significant importance to the football world, concerns examining the legality of certain FIFA rules, particularly those contained in Article 17 of the FIFA Regulations on the Status and Transfer of Players (FIFA RSTP).

To summarize the situation that led to this ruling, it all started on 19 September 2022. The Mons Court of Appeal, located in the Wallonian region of Belgium, referred the Lassana Diarra case to the CJEU. The case involves the French footballer Lassana Diarra challenging the legality of the compensation claim against him for terminating his contract with the Russian side of Lokomotiv...
