In this landmark decision, the Court of Arbitration for Sport (CAS) dealt for the first time with the question of whether a national football association could enforce a FIFA Dispute Resolution Chamber (DRC) decision on training compensation in lieu of a disaffiliated club. Contrary to FIFA’s view, CAS answered the question negatively.
Facts
In June 2017, FC Abuja - affiliated with the Nigerian Football Federation (NFF) - lodged a claim against the Latvian club, FK Ventspils, for training compensation with the DRC.
In June 2018, the DRC awarded training compensation in favor of FC Abuja of EUR 87,616.43 plus interest (DRC Decision). The DRC Decision was issued with grounds upon FK Ventspils request. As neither party appealed, it became final and binding.
In October 2018, NFF informed FIFA that FC Abuja had been “disbanded.”
In April 2019, NFF requested that the FIFA DC enforce the DRC Decision in favor of NFF. FIFA refused to implement the DRC Decision and invited NFF to file a new petition with the DRC.
