The potential impact of Brexit on the ability of Premier League clubs to utilise Article19’s “EU/EEA exception” to recruit talented U18s

On 23 June 2016, a referendum was held on whether the United Kingdom (UK) should remain in the European Union (EU) or leave. The UK public voted for “Brexit,” that is, to leave the EU, by a margin of approximately 52% voting to leave and approximately 48% voting to remain.

Given that the terms upon which the UK’s exit from the EU are still uncertain, there is much speculation as to the impact on EU nationals either currently living in the UK or seeking to take up employment there in the future. That said, as matters have progressed since the monumental referendum, one significant and likely consequence of Brexit may be the loss of the ability to utilise the exemption contained in Article 19(2)(b) of the FIFA Regulations on the Status and Transfer of Players (RSTP).
