Football Legal: Have you noticed a recent trend towards increasing complexity in transfer contracts between clubs, particularly with regard to specific clauses (buy-out, buy-back, sell-on, etc.)?
FIFPRO: No, we have not seen a real increase in complexity in recent years. We have obviously spotted a change of approach when FIFA introduced Article 18bis paragraph 1 of the FIFA Regulations on the Status and Transfer of Players (FIFA RSTP) and started to sanction clubs but the complexity has, to a certain extent, always been there as the tendency of clubs wanting to have a say on the future career of a player even though the employment contract has already expired is nothing new within the football labor market. That, of course, does not make it legal. However, FIFPRO has noted with concern an increase in transfer agreements by means of which the new club agrees to pay the former club...
