Why the provisions of Article 12bis implemented at national level did not improve the overdue payables situation in Ukrainian football

On 23 January 2015, by means of the Circular no. 1468 (the Circular), FIFA informed the international football community that the FIFA Executive Committee had adopted several changes to, inter alia, the FIFA Regulations on the Status and Transfer of Players (the FIFA Regulations), amongst which was an amendment to the mentioned FIFA Regulations at Article 12bis.

In accordance with the Circular, Article 12bis was the most important addition to the FIFA Regulations. The mentioned article was drafted and implemented with the aim to establish a stronger system with regard to overdue payables (towards players and clubs). In this respect, the Dispute Resolution Chamber (DRC) and the Players' Status Committee (PSC) will have a wide scope of discretion when imposing sporting sanctions (under Article 12bis, the FIFA DRC and PSC are authorized to apply sanctions for the violation of financial obligations by clubs in form of warnings,...
