Marcos Rojo case: the Swiss Federal Tribunal confirms the CAS award and backs up the position of Doyen

On 13 December 2016, the Swiss Federal Tribunal rejected Sporting Clube de Portugal’s appeal against the CAS award of 21 December 2015, which ordered it to honour the TPO contracts signed with Doyen.

Facts

In this case and as a reminder, Sporting Clube de Portugal joined forces with the company Doyen Sports Investments in July 2012 to finance the recruitment of players Marcos Rojo and Zakaria Labyad, and therefore granted a percentage of the economic rights related to these players: 35% for Zakaria  Labyad and 75% for Marcos Rojo.

Sporting Clube de Portugal had instructed Doyen to look for clubs interested in buying Marcos Rojo, but with Rojo playing particularly brilliantly during the 2014 World Cup in Brazil, the Portuguese club changed its mind and asked Doyen to end its research. Doyen, however, continued their efforts and, having reached an agreement with Manchester United, had notified Sporting Clube de Portugal a transfer offer worth EUR 20 million.
