Unveiling the Decision-Making of the FIFA Disciplinary Committee

This paper aims at sparking a new debate, concerning the application of sanctions of the FIFA Disciplinary Code by the FIFA Disciplinary Committee and the importance of such decisions to be coordinated with the internationally recognized humanitarian notion of the right to a fair trial.

Introduction

When compared with other legal bodies adjudicating matters of sports, and their competence over a number of disputes ranging from issues relating to disciplinary conduct or doping, it can be safe to say that there are only a few members of the international sporting community who navigate the specific areas covered by the FIFA Disciplinary Committee.

The reason for the above is because the Disciplinary Committee of FIFA only deals with specific matters[1] covered under the FIFA Disciplinary Code. It seems that this might be the reason why we do not hear many debates over the functioning of the FIFA Disciplinary Committee.

Preliminarily, pursuant to the FIFA Statutes, the role of the FIFA Disciplinary Committee is set out in the FIFA Disciplinary Code.
