Sport Punitive Proceedings in Colombia

As in other jurisdictions, Colombia has a special legal regime for the domestic regulations of sports, encompassed with the international system. The National System of Sports of Colombia (NSS) was created by Law 181 of 1995  and regulated through the Decrees 1228 of 1995  and 1085 of 2015. In addition to the NSS framework, this legal regime grants the Colombian Ministry of Sports (CMS) the means to inspect, make vigilance and control the sport organisms, including professional clubs.

Through this regime, the CMS oversees the compliance of the sports organisms with the legal framework previously referred, and in those when the entity identifies misconduct, depending on the severity of the fault, the CMS has two possibilities. On the one hand, for those cases when the failures can be amended, there can be subscribed agreements between the CMS and the organisms to create commitments that enshrine the correction of those infringements. On the other hand, when the organisms breach said commitments or their failures are of such seriousness, the law grants...
