The case was a claim for breach of Article 17 of the FIFA Regulations on the Status and Transfer of Players (FIFA RSTP) filed both by the player Gastón Silva and the club Independiente.

During his stay at Independiente, the player claimed some overdue payables. The player invoked the Argentine Collective Bargaining Agreement (CBA) in his warning to the club, which is more beneficial than the FIFA RSTP (48 hours to pay).
