CAS 2022/A/8844 Olea Sports Capital LLC v. Football Union of Russia & JSC Professional Football Club CSKA (Moscow)
The Court of Arbitration for Sport (CAS) recently issued three awards in similar arbitrations between the same Appellant, a football intermediary, Olea Sports Capital LLC, and two football clubs, being the Respondents. In all those three cases, there were intermediary services allegedly rendered by the Appellant and, in all three cases, there was no representation contract signed between the Appellant and the respective club. However, the outcome of the cases is absolutely different, as well as the approach made by the CAS.
Below, we will provide a comparison of the cases that, despite looking similar, have certain differences in their factual background, as well as different CAS Panels, that impacted the final result.
For practical matters, the following cases will hereafter be referred to as Case 1, Case 2 and Case 3:

For the same reason, the main parties to the cases will hereinafter be referred to as “the Intermediary” and “the Club”.
