Jean-Clair Todibo: Ethical Breach or Infringement of Personal Autonomy?

During the match between the national representative teams of France and the Netherlands at the Johan Cruyff Arena as part of the qualifiers for EURO 2024, a minute’s silence was observed, not only as a tribute to the victims of the current Israeli-Palestinian conflict since 7 October 2023, but also in relation to the knife attack that claimed the life of a secondary school teacher in France. During the minute’s silence, which all the players and supporters observed, the images briefly showed French national team player Jean-Clair Todibo discreetly laughing on the bench. Public opinion seized on this incident and expressed its indignation at this behavior, which is considered inappropriate at a solemn moment.

Following the incident, the French Football Federation’s (FFF) National Ethics Council (CNE) wrote to Jean-Clair Todibo asking him to explain “his incomprehensible attitude”, reminding him that the CNE could always refer the matter to the French Football Federation’s Disciplinary Committee. The OGC Nice center-back then made a point of apologizing at a press conference on Monday, 16 October 2023, referring to a “nervous laugh” whose purpose was “in no way to mock”.

As the economic and political stakes in football become ever higher, this context gives players more and more social responsibility when they are in public, particularly on television. This incident raises questions about the control and repression of the behavior and actions of professional players and, ultimately, about their real freedom to behave as they wish, on and off the pitch, even when these behaviors are not...
