Impact of the extension of the season 2019-2020 and the subsequent transfer window on the interpretation of contractual clauses

On 4 November 2022, the Court of Arbitration for Sport (CAS) dismissed the Appeal of Leeds United FC[1]  against a decision rendered by the Single Judge of the FIFA Players’ Status Committee (FIFA PSC) on 1 June 2021. The object of the dispute was the payment of the first installment of a transfer fee regarding the player Jean-Kevin Augustin.

Facts of the Case

1. On 25 January 2020, RasenBallsport Leipzig (RB Leipzig), Leeds United FC (LUFC) and the player Jean-Kevin Augustin concluded a tripartite loan agreement about the temporary transfer of the player from RB Leipzig to LUFC with a term until 30 June 2020.

Among others, this agreement contained a clause that entitled LUFC to permanently transfer the player to LUFC
