The present article aims to analyze Russia’s existing legal framework regarding the distribution of broadcasting rights in football, their exploitation and protection.
Legal framework
Although the legal nature of broadcasting rights is not widely recognized as intellectual property,[1] the concept of broadcasting rights in the Russian legal system is very similar to the concept of intellectual rights.
Same as intellectual rights, the broadcasting rights arise from the provisions of the Civil Code of the Russian Federation (CC RF) pertaining to the rights on protected results of intellectual activity and equal means of individualization of legal entities, goods, works, services, and enterprises - chapter 69 CC RF.
From this scope, broadcasting rights are similar to a message on the air on radio or TV broadcasting.
However, the sports broadcasting concept has its own peculiarities compared to other radio or TV messages covering different events.
