In this case, the Court of Arbitration for Sport rejected a coach’s claim for further compensation, finding that he had already accepted a mitigated settlement and waived additional claims by not including them in his Statement of Appeals. Legally, the Sole Arbitrator held that the coach was not entitled to performance-based bonuses post-termination and that accepting partial mitigated compensation did not entitle him to further payments, mainly since he contributed no substantial performance after being dismissed.

Facts


On 17 July 2022, the Club Al Tai Club and the Coach Pedro Miguel Marques Costa Filipe signed a contract for the Club’s first team for the 2022-2023 sporting season and according, to Article 3 of the Employment Contract, the Coach was entitled to a total amount of EUR 1.3 million with the breakdown specifications mentioned in the Appeal.
