CAS states that while assessing the degree of a debtor’s diligence in sporting succession cases, the said assessment should be made based on a case’s specific circumstances rather than enforcing general rules.

Facts and Procedure

 

Estonian club Tartu Jalgpslliklubi Tammeka (Tartu) was notified, on 4 March 2014, that Croatian side Otok had filed a claim before the FIFA DRC requesting the payment of training compensation regarding the Player S. Otok was later informed that Tartu was under liquidation according to the relevant Estonian regulations. However, on 21 May 2014 and 6 August 2014, the Estonian Football Association (EFA) confirmed that Tartu was still its affiliated member upon FIFA’s request.
