On 22 December 2022, the Spanish Congress of Deputies plenary session approved Law 39/2022 of 30 December 2022, on Sport or “the new Sports Law”, thus replacing the previous Law 10/1990 of 15 October 1990. In the words of the Preamble of this new Law: “The Spanish sports model has been subject to a constant evolution as a result of the continuous and dizzying changes affecting this social phenomenon, which every day extends the practice of sports to a greater number of citizens, and reaches a projection in society that was hardly foreseen a few decades ago.” Thus, this legislative renovation seemed necessary for a clear adaptation to the social needs of the moment.[1]
Introduction
One of the main characteristics of this new Law on sport, with respect to its predecessor, is the denomination of sport as a right and essential activity, thus assuming responsibility for the public authorities, its protection and the adequacy of the entire sports context so that its practice is ideal. This promotes a welfare society based on the values that sport should represent and a clear nod to the health benefits of correct sports practice. To this end, the Law provides the public authorities with the capacity to carry out plans and policies aimed at promoting the practice of sports. Furthermore, with this new conception of sport as a right, one of the principles promulgated by this Law is to protect the practice of sport in a safe environment.
