The Paris Court of Appeal has just struck a dramatic blow! In an important decision rendered on 14 October 2021, the Parisian Court annulled Article P.6.3.0.3 of the Internal Regulations of the Paris Bar Association, adopted at the beginning of June 2020, which allowed registered lawyers to carry out intermediation activities such as putting players and clubs in contact with each other. Such a connection is qualified as a “principal commercial activity”, which is prohibited for lawyers. This is a severe setback to sports lawyer agents and, conversely, a “victory” for traditional sports agents.

A few days after a ruling by a French Administrative Court declaring that administrative jurisdiction is incompetent to challenge the legality of the Internal Regulations of the Paris Bar Association (RIBP), the Paris Court of Appeal (the Court) ruled on the dispute opposing licensed sports agents by the French Football Federation (FFF) to sports lawyers for many months. Finally, the Court ruled in favor of sports agents.
