  1. According to Swiss Law, in a bilateral contract, a party may not demand performance until it has discharged or offered to discharge its own obligation. However there is no provision stating that the consequence is that the contract is automatically terminated.

  2. A club does not have legitimation to request the imposition of disciplinary sanctions on a player or club directly to CAS.
